Meghan Markle’s new brand As Ever has been banned from selling clothing because it is likely to cause confusion, documents have revealed.
The Mail on Sunday revealed that documents filed at the US Patent and Trademark Office (USPTO) in October 2022 by Meghan’s lawyers showed how the duchess had originally applied for permission to sell a number of lifestyle goods under her new brand, including jam, dog biscuits, aprons and other items of clothing.
However, USPTO ruled that Meghan, 43, would not be able to sell clothing because her company’s name was too similar to Chinese ‘fast fashion’ brand ASEVER, which is based in Shenzhen.
USPTO said: “The marks are identical in sound and virtually identical in appearance and are thus confusingly similar for the purposes of determining likelihood of confusion.”
As reported by The Mail On Sunday, Meghan’s lawyers had to file another application as a result of this partial-rejection, which did not apply for permission to sell clothing. This revised trademark application for ‘As Ever’ was then fully approved.
